Terms of Service
The contract between Gendemy and educational institutions, administrators, educators, and students accessing our platform.
1. Acceptance & Eligibility
By creating an account, subscribing to our SaaS plans, downloading our mobile applications from the Google Play Store, or using our services (the “Services”), you agree to be bound by these Terms of Service (the “Terms”).
If you are registering on behalf of an educational institute, coaching center, school, or corporate academy (an “Institute”), you represent and warrant that you possess the legal authority to bind that entity to these Terms. Users under the age of 18 must use the application under the authorization of their registered educational institution or parent/guardian.
2. Account Security & Responsibilities
To access the Services, you must register using a verified email address and mobile phone number. You agree to:
- Provide accurate, current, and complete registration details.
- Maintain the confidentiality of your login credentials and authentication tokens.
- Promptly notify us upon becoming aware of any unauthorized account access or security breach.
- Ensure that administrators assign appropriate role permissions (Admin, Faculty, Student) based on the principle of least privilege.
3. SaaS Subscriptions, Invoicing & Billing
- Subscription Plans: Gendemy offers tiered subscription plans (Starter, Growth, Pro, Enterprise) with configurable student quotas, branch allowances, and feature packages. Pricing is billed periodically (monthly, quarterly, semi-annually, or annually).
- Free Trial: New institutes are entitled to a zero-risk 14-day free trial. No credit card or upfront deposit is required. At the conclusion of the trial period, access to administrative write features requires choosing a paid plan.
- Taxes & GST: All software subscription fees are subject to statutory Goods and Services Tax (GST) in India. Official GST tax invoices will be issued to registered organizations containing their verified GSTIN.
- Zero-Value Invoices: Promotional grants, trial credits, or 100% discount periods result in zero-rupee tax invoices which bypass third-party payment aggregator popups and are activated immediately.
- Refund Policy: SaaS subscription charges are non-refundable once the billing cycle commences, except where required by law or in the case of verified double-billing errors.
4. Student Fee Collection (Direct Merchant Settlement)
Gendemy provides integrated tools for institutes to define student fee plans, generate fee dues, and facilitate online tuition fee collections:
- Direct Settlement (BYOK): When students pay tuition fees online, funds settle directly from the student into the institute's own registered bank account via the institute's verified payment gateway account (e.g., Razorpay Standard Merchant Onboarding).
- Zero Intermediary Escrow: Gendemy does not act as a custodial escrow agent for student fee payments. The institute is solely responsible for issuing valid tuition receipts, GST/educational tax exemptions, and managing student refund disputes.
5. Intellectual Property & Data Ownership
Your Data Belongs to You: The Institute retains 100% ownership, title, and intellectual property rights in all student records, curriculum files, evaluation remarks, and financial ledgers uploaded to or generated within the platform (“Customer Data”).
Platform IP: Gendemy, its visual design, user interface components, software architecture, APIs, and proprietary branding are the exclusive property of Gendemy and its licensors.
6. Acceptable Use & Conduct
You agree not to misuse the Services. Prohibited actions include:
- Attempting to probe, scan, or breach the security vulnerabilities of our network, database, or API infrastructure.
- Reverse-engineering, decompiling, disassembling, or extracting source code from our web or mobile application bundles.
- Uploading malware, malicious code, or unsolicited bulk commercial messages (spam).
- Using the platform to harass, defame, or infringe upon the privacy rights of students, teachers, or administrators.
7. Service Levels & Maintenance
We target a service availability of 99.9% uptime for our core database and API services during academic hours. Planned maintenance windows are scheduled during low-traffic periods (typically between 01:00 AM and 05:00 AM IST) with prior dashboard notice.
8. Disclaimers & Limitation of Liability
The Services are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by applicable law in India,Gendemy disclaims all warranties, express or implied. In no event shall Gendemy be liable for any indirect, incidental, consequential, or punitive damages, or loss of profits or data, exceeding the total fees paid by the Institute in the three (3) months preceding the incident.
9. Termination & Cancellation
You may cancel your subscription at any time through the Admin billing settings. Upon cancellation, your account will remain active until the end of the paid billing period. Institutes may export complete student, attendance, and fee history in standard digital formats (CSV, Excel, PDF) prior to account termination.
10. Governing Law & Dispute Resolution
